Official Release: CSD estimates the emergency precautionary measure requested by FC Barcelona and by players Dani Olmo and Pau Víctor

The CSD has analysed the appeal of 52 pages and the more than 60 documents accompanying it.

Madrid, 8 January 2025.- The Superior Council of Sports (CSD) on Wednesday estimated the urgent precautionary measure requested by FC Barcelona and by the players Dani Olmo and Pau Víctor.

This measure, which is provisional until the appeal lodged by the club and the aforementioned players is finally resolved, suspends the Agreement of the Monitoring Committee of the RFEF-LaLiga Coordination Convention, dated 4 January 2025, and the cancellation of the sports licences of the aforementioned players. It also maintains the validity of such licences until the present appeal is definitively resolved.

For the purpose of estimating this emergency precautionary measure, the CSD has analysed the appeal of 52 pages, and the more than 60 documents accompanying it. In their argument, FC Barcelona, Dani Olmo and Pau Víctor point out that the Monitoring Committee is attributed exclusively to the functions of interpreting the application of the clauses of the RFEF-LaLiga Coordination Convention, to monitor compliance with what has been agreed and to promote all other activities that aim to make the Convention more effective.

They therefore question the competence of the Monitoring Committee to grant or not to grant the prior visa or the final licence of professional football players, appreciating signs of full invalidity in the Agreement of the Monitoring Committee of the RFEF-LaLiga Coordination Convention.

Without prejudice to the claims made for the settlement of the merits of the case, the CSD has noted the possible concurrence of a case of full invalidity and the existence of immediate and difficult damages, which would affect the rights recognized in the current Sports Act to the players Dani Olmo and Pau Víctor and their legal certainty.

In this sense, the CSD has assessed that, according to Article 27 of the Sport Law, professional athletes have the right “to a sports career according to their potentialities” and with all guarantees and certainty.

At the moment, FC Barcelona and its players are immersed in the Spanish Supercup, the first official title of the season, of global visibility and impact, and in which only teams that have had the best performance in the national competitions in the previous year participate.

The CSD considers that the failure to adopt this precautionary measure would cause serious economic and sports damage to the club and, above all, to football players. This could also damage the interests of the Spanish team, as well as the other national competitions, including LaLiga.

Finally, the CSD stresses that this decision does not prejudge the substantive issues raised in the appeal.
