
Administrative Court of Sport
DEFINITION AND COMPETENCES
The Administrative Court of Sport is a collegiate body at the state level, organically attached to the Higher Sports Council which, acting independently of it, assumes the following functions:
- To decide administratively and ultimately the disciplinary sports issues of its competence, those indicated in Organic Law 3/2013, of June 20, on the protection of the health of the athlete and fight against doping in sports activity and to know the special administrative remedy regulated in article 40 of the aforementioned Organic Law.
- Process and resolve disciplinary files, ultimately administrative, at the request of the President of the Higher Sports Council or its Board of Directors, in the specific cases referred to in article 76 of the Sports Law.
- To ensure, immediately and ultimately administratively, compliance with the law of electoral processes in the governing bodies of the Spanish sports federations.
COMPOSITION
The Administrative Court of Sport is composed of seven members with a degree in law, of whom one President shall be appointed by election from among its own members.
In addition, you will be assisted by a Secretary licensed or graduated in Law, appointed by the president of the CSD.
Its composition will guarantee the fulfilment of a balanced presence of women and men.
The members of the Administrative Court of Sport will be appointed by the Board of Directors of the Higher Sports Council. Four members will be appointed on the proposal of the President of the CSD and three of those proposed by the Spanish sports federations.
The term of office of its members shall be six years and they may not be re-elected. However, the renovation will take place partially every three years.
PROCEDURE AND RESOLUTIONS
The functioning of the Administrative Court of Sport is in accordance with the provisions of Law 30/1992.
Its resolutions, which exhaust the administrative channel, are executed by the corresponding Spanish sports federations, the AEPSD, professional leagues, club groups or those entities that are subject to the competence of the Administrative Court of Sport.
Based on Royal Decree 53/2014, of 31 January, which develops the composition, organization and functions of the Administrative Court of Sport, its resolutions are public, respecting the right to honour and privacy of people, with observance of the adequate protection of personal data, in accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data.
For this purpose, they are inserted in the electronic headquarters of the Superior Sports Council, as well as in that of the Spanish Agency for the Protection of the Health of the Athlete.
