Administrative Tribunal for Sport
DEFINITION AND POWERS
The Administrative Tribunal for Sport is a collegiate body at the state level, organically attached to the Higher Council for Sports which, acting independently of it, assumes the following functions:
- To decide administratively and ultimately the disciplinary sports issues of its competence, those mentioned in the Organic Law 3/2013, of 20 June of protection of the health of the athlete and fight against doping in sports activity and to know the special administrative resource regulated in article 40 of the aforementioned Organic Law.
- To process and resolve disciplinary files, ultimately administrative, at the request of the President of the High Council of Sports or its Steering Committee, in the specific cases referred to in Article 76 of the Sport Act.
- Ensure immediate and ultimately administrative compliance with the electoral processes in the governing bodies of the Spanish sports federations.
COMPOSITION
The Administrative Tribunal for Sport consists of seven members who are legally qualified, from whom a President shall be appointed by election among its own members.
In addition, it will be assisted by a Secretary who is a graduate of law, appointed by the Chairman of the CSD.
Its composition will ensure that there is a balanced presence of women and men.
The members of the Administrative Tribunal for Sport shall be appointed by the Steering Committee of the Higher Council for Sports. Four members will be appointed on a proposal from the President of the CSD and three from those proposed by the Spanish sports federations.
The term of office of its members shall be six years and shall not be re-elected. However, the renewal will take place partially every three years.
PROCEDURE AND RESOLUTIONS
The functioning of the Administrative Tribunal for Sport is in accordance with the provisions of Law 30/1992. Its resolutions, which exhaust the administrative route, are implemented by the relevant Spanish sports federations, AEPSD, professional leagues, club groups or entities which are subject to the competence of the TAD.
